Summer Meeting - 27 July 2006

The next gathering of the Scottish Competition Law Forum will take place on the evening of 27 July. The focus of the summer meeting will be state aid.

On the night, the Forum will be joined by Robert Hankin, Head of the Regional Aid Unit at the European Commission and Sheena Brown, Head of the State Aid Unit at the Scottish Executive. We will also be hearing from Lindsay Gardiner who is working on the OFT consultation on subsidies.

State aid is a topic of significance to the public and private sectors alike in Scotland and the evening represents an excellent opportunity to ask questions and engage in debate.

If you have specific points that you would like the speakers to touch upon, please do let us know. This will give us the ability to tailor the event to address the specific concerns you might have in relation to the state aid regime and will give the event its customary Scottish flavour. As always there will also be an opportunity to ask questions and raise points on the evening.

Registration is at 17.30 and the meeting will be starting at 18.00. The evening will conclude with a drinks reception at approximately 20.00.

The meeting is hosted by the Faculty of Advocates and the details are as follows:

Venue: The Mackenzie Building, Old Assembly Close, 172 High Street, Edinburgh, EH1 1QX.

Time: Registration at 17.30, with the meeting commencing at 18.00.

Next CLA Meeting - 6 July 2006

The next CLA meeting will be held on Thursday, 6 July at 6pm at the offices of Simmons & Simmons, CityPoint, One Ropemaker Street, London, EC2Y 9SS.  Professor Jeremy Phillips has kindly agreed to speak on the following subject:

Class warfare: where trade and trade marks collide”

CLA is pleased to welcome Professor Jeremy Phillips to address the meeting on the topical subject of the consequences of the Class International decision of 18 October 2005 (Case C-405/03).  The case turned on the difficulties in determining when goods are “placed on the market”, with the ECJ’s judgment coming perilously close to saying that free movement of goods overrides intellectual property rights.  The case marks a new frontier in the EU’s long struggle to align the interests of free movement of goods with those of industrial property rights.

Jeremy Phillips is widely regarded as one of the leading academic lawyers in the field of intellectual property, and as a distinguished speaker well known for his insightful and stimulating approach.  He joined the Queen Mary Intellectual Property Research Institute in 2003 as a Professorial Fellow having been Intellectual Property Consultant to Slaughter and May since 1994.  Among his many publications, his book, Trade Mark Law: a Practical Anatomy (Oxford University Press, 2003), acquired instant cult status for its unique mixture of legal analysis and commercial comment.  Jeremy is co-blogmeister of the IPKat weblog (http://ipkitten.blogspot.com), the influential European intellectual property law weblog.

If you would like to attend the meeting, please return the attached reply slip to me, together with a cheque in the sum of £20 (for full members of the CLA), £25 (for non-members) or £10 (for associate members) made payable to The Competition Law Association, by Monday, 3 July.  Tickets will not be issued.

Please also remember to claim your Law Society or Bar Council credits for attending these meetings.  1 CPD point will be available and the Law Society CPD reference is TCLA.  An attendance record is kept by the Association and may be signed at the meeting.

With kind regards

Sharon Horwitz
Secretary
